1. Introduction#

This Refund & Cancellation Policy (“Policy”) governs subscription cancellations, refunds, billing cycles, and payment obligations for all users of AI WorkerX Sdn. Bhd. (“AI WorkerX”, “we”, “us”, “our”).

This Policy forms part of the Terms & Conditions and should be read together with it.

2. Subscription Cancellation by Customer#

2.1 How to Cancel#

You may cancel your subscription at any time by using the built-in cancellation button in the billing portal. If you require assistance, contact: support@aiworkerx.com

2.2 Effective Date of Cancellation#

Unless otherwise stated in your Order Form, cancellation takes effect at the end of the current billing cycle.

2.3 Payment Obligations Until End of Term#

You remain fully responsible for subscription fees up to the end of the billing period in which the cancellation occurs.

2.4 No Prorated Refunds#

Fees for the current billing period are non-refundable, except where stated otherwise in Section 3.

2.5 Automatic Renewal Notice#

Subscriptions renew automatically unless cancelled before renewal. You are responsible for cancelling prior to renewal to avoid being charged for the next billing cycle.

2.6 Cancellation Does Not Refund Top-Ups#

Cancelling a subscription does not refund unused Top-Up Responses. Unused Top-Up Responses remain available until they expire (12 months from purchase) unless otherwise stated.

3. Refunds#

3.1 Non-Refundable Fees (Default Rule)#

All subscription fees paid to AI WorkerX are non-refundable.

3.2 Exceptional Refunds (At AI WorkerX’s Discretion)#

Refunds may only be issued at AI WorkerX’s sole discretion for cases including:

3.3 Maximum Refund Amount (Liability Cap)#

Where a refund is approved, the maximum refund is limited to the unused portion of the relevant billing period.

3.4 Refund Method#

Approved refunds will be processed back to the original payment method unless otherwise agreed.

3.5 Top-Up Responses (Prepaid Usage)#

a. Non-Refundable by Default. Top-Up Responses are prepaid digital usage entitlements and are non-refundable once purchased, except where required by applicable law or where AI WorkerX confirms an incorrect billing caused by a system error.

b. Validity and Expiry. Top-Up Responses expire 12 months from the date of purchase. Any unused Top-Up Responses expire and are forfeited (“burned”) at the end of the validity period.

c. No Refund for Expiry. Expiry/burn of unused Top-Up Responses does not qualify for a refund, credit, or extension, except where required by law.

d. Priority Deduction. Plan Responses are deducted first. Top-Up Responses are deducted only when Plan Responses are insufficient.

e. Duplicate Charges / Billing Errors. If you believe there is an incorrect Top-Up charge (e.g., duplicate charge), notify us within the timeframe in Section 7.1 with your receipt/invoice reference.

4. Termination by AI WorkerX#

4.1 Termination for Cause#

If we terminate your account due to:

4.2 Termination Without Cause#

If AI WorkerX terminates your subscription without cause, you will receive a pro-rated refund for the unused portion of your subscription term.

5. Mid-Term Subscription Changes#

5.1 Downgrades#

If you downgrade your plan mid-term:

Upgrades take effect immediately, and the difference will be billed on a prorated basis where applicable.

6. Payment Failures#

6.1 Automatic Suspension#

If payment fails, we may suspend your account until payment is successfully received.

6.2 No Waiver of Fees#

Suspension does not relieve you of outstanding payment obligations for the affected period.

7. Billing Disputes#

7.1 Reporting Disputes#

If you believe there is an error in billing, notify us within 7 business days at support@aiworkerx.com

7.2 Resolution Process#

We will investigate and respond within 14 business days.

7.3 Chargebacks and Payment Disputes#

a. Contact First. Before initiating a chargeback, you agree to contact AI WorkerX at support@aiworkerx.com and provide reasonable details so we can investigate and attempt resolution.

b. Suspension During Dispute. If a chargeback or formal payment dispute is initiated, AI WorkerX may suspend or limit access to the Service while the dispute is being investigated.

c. Evidence Submission. You authorise AI WorkerX to submit relevant records to payment processors/banks for dispute handling, including invoices/receipts, subscription and cancellation timestamps, service usage logs, support communications, and delivery evidence. Payment processors may require merchants to retain and provide proof of consent for recurring/tokenised/auto-debit payments.

d. Processor Rights Affecting Subscriptions. You acknowledge that payment processors may immediately cancel subscriptions and/or stop processing future payments upon receipt of a chargeback or complaint, and AI WorkerX is not liable for losses arising from such processor actions.

e. Bad-Faith Disputes. If a chargeback is filed in bad faith or for services already delivered, you remain liable for amounts properly owed and any non-recoverable dispute/processing fees to the extent permitted by law.

7.4 Billing Error Window#

To reduce disputes and enable timely resolution, you should report billing issues within the timeframes in Section 7.1.

8. Exclusive Remedy Clause#

To the fullest extent permitted by law:

Any refund issued under this Policy is your sole and exclusive remedy for any dissatisfaction with the Service.

You waive all rights to claim additional compensation except where required by law.

9. No Refund for AI Output Quality#

Due to the nature of AI systems:

do not qualify for refunds.

You are responsible for reviewing outputs before acting upon them.

10. No Refund for Third-Party Failures#

Refunds will not be granted for failures caused by:

Updates take effect upon publication, and continued use of the Service constitutes acceptance of the updated Policy.
